Terms of Service

1. The Service

Performance Chores helps households create, assign, schedule, track, and communicate about chores and shared tasks. We may add, change, suspend, or discontinue features from time to time. These Terms apply to the Service and do not replace any separate written agreement expressly signed by Performance Chores.

2. Eligibility

You must be legally able to enter into these Terms. If you have not reached the age of majority where you live, you may use the Service only with permission and supervision from a parent or legal guardian. Children under 13 may not create accounts independently.

3. Accounts and Credential Security

You agree to provide accurate, current, and complete account information and to keep it updated. You are responsible for protecting your credentials and for activity under your account. Notify us promptly at info@performancechores.com if you suspect unauthorized access or use. We may suspend or secure an affected account to protect the Service and its users.

4. Household Groups and Permissions

The Service may allow a household organizer or authorized member to invite others, create profiles, assign chores, and manage household settings. You are responsible for obtaining permission before providing another person's contact information or adding that person to a household. Household members and organizers may not enroll another person's mobile number in SMS messages without that person's authorization.

5. User Content

You may submit chores, assignments, schedules, notes, photos, messages, and other content ("User Content"). You retain ownership of your User Content. You grant Performance Chores a limited, non-exclusive license to host, process, reproduce, and display User Content only as reasonably necessary to operate, secure, and improve the Service. You are responsible for your User Content and for having the rights needed to submit it.

6. Acceptable Use

You will not use the Service to:

• Break the law, infringe another person's rights, or facilitate harm.
• Harass, threaten, impersonate, defraud, or mislead another person.
• Submit unlawful, infringing, malicious, or deceptive content.
• Access an account, system, or data without authorization.
• Probe, disrupt, overload, or interfere with the Service or its security.
• Introduce malware or use automated means to scrape or abuse the Service.

We may restrict or terminate access for violations of this section.

7. Service Availability and Changes

We work to keep the Service available, but we do not guarantee uninterrupted access or that every feature will always be offered. Maintenance, security events, third-party outages, or other circumstances may delay or interrupt the Service. We may update the Service and its requirements as reasonably necessary.

8. Feedback

If you provide ideas, suggestions, or other feedback about the Service, you grant us the right to use that feedback without restriction or compensation. This does not transfer ownership of your personal User Content.

9. Intellectual Property

The Service, including its software, design, features, branding, and content other than User Content, is owned by Performance Chores, YetiWerks, or their licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service as intended. Except where applicable law does not allow a restriction, you may not copy, modify, distribute, sell, lease, or reverse engineer the Service.

10. Third-Party Services

The Service may rely on or link to third-party services. Those services may have their own terms and privacy policies, and Performance Chores is not responsible for third-party content, availability, or practices. Your use of a third-party service is governed by your agreement with that provider.

13. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that User Content will be accurate or lawful. You use the Service at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, Performance Chores, YetiWerks, and their members, officers, employees, contractors, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, use, goodwill, or reputation, arising from or relating to the Service. Our aggregate liability for claims relating to the Service will not exceed the greater of one hundred US dollars (US $100) or the amount you paid to Performance Chores for the Service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Performance Chores, YetiWerks, and their members, officers, employees, contractors, and agents from claims, losses, liabilities, and reasonable costs arising from your misuse of the Service, your User Content, your violation of these Terms, or your violation of another person's rights.

16. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for the Service or others, or where required by law. Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, liability, indemnification, and general legal terms.

17. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law rules. Unless applicable law requires otherwise, claims arising from these Terms or the Service must be brought in a state or federal court located in Nebraska, and you consent to jurisdiction in those courts.

18. Changes to These Terms

We may update these Terms from time to time. The current version and its last-updated date will be posted at performancechores.com/terms. If a change is material, we may also provide notice through the Service or another reasonable method. Continued use after updated Terms take effect means you accept them.

19. General

If a provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and Performance Chores concerning the Service unless a separately signed written agreement applies. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets. A failure to enforce a provision is not a waiver.
